Terms of Use

These Terms of Use apply to cashbaq.cloud and the referral service offered through it by Cashbaq (“we”, “us”). By using the site or registering, you agree to these terms. If you don't agree, please don't use the site. Our Privacy Policy explains how we handle your personal information.

• Cashbaq is a referral service. We are not a real estate brokerage, and we don't provide real estate, mortgage, legal, tax or financial advice.
• When you register, we try to match you with a licensed realtor who works in your area. Realtors in our network are independent professionals registered with their provincial regulator. They are not our employees or agents, and they alone are responsible for the services they provide to you.
• We can't guarantee that we will find a match for every request, or that a realtor will be available in every area.
• Registering is free and doesn't oblige you to work with any realtor or to buy a property.

• The cashback is 50% of the commission your matched realtor actually receives on your purchase. It is offered by the realtor and paid by their brokerage, not by Cashbaq.
• Before you start working together, your realtor's brokerage will set out the cashback in a written agreement (usually your buyer representation agreement). That agreement, not this website, sets the amount, conditions and timing of the payment.
• Cashback is paid only if your purchase closes through your matched realtor, and only after the brokerage receives its commission. For pre-construction purchases, builders often pay commission in stages or after occupancy or closing, so cashback may be paid later.
• Commission rates vary. The figures in our calculator and examples use typical rates (for example 2.5% on resale and 4% on pre-construction) and are estimates only.
• Commission rebates must follow the rules of your province's real estate regulator and may not be available for every transaction. Your lender may need to be told about the cashback, and it may have tax consequences. Please check with your mortgage professional and accountant.

You must be at least 18 years old and looking to buy property in Canada. If you have already signed a buyer representation agreement with another realtor, you need to end or complete that agreement under its terms before we can match you. Please tell us on the form if you're working with a realtor.

You agree to give us accurate, current information and to register only for yourself or with the permission of the person you're registering. We handle all personal information under our Privacy Policy. We only contact you, and only share your details with a matched realtor, with the consent you give on the registration form. You can withdraw it at any time.

Please don't misuse the site. For example, don't submit false or automated registrations, try to get into parts of the site or our systems you're not authorised to use, or interfere with how the site works. The Cashbaq name, logo and the content of this site belong to us. You may use the site for your own personal, non-commercial use.

We provide the site and the referral service “as is”. We work to keep the information on the site accurate, but we don't guarantee that it is complete or error-free, or that the site will always be available.

To the extent the law allows, Cashbaq is not responsible for the advice, services, conduct or payments of any realtor or brokerage, or for any loss arising from a property purchase. Our total liability to you for any claim relating to the site or the referral service is limited to $100. Nothing in these terms limits any rights you have under consumer protection laws that can't be waived.

We may change or stop the service, or update these terms. We will post the updated terms here with a new effective date. Changes don't affect a cashback agreement you have already signed with a brokerage.

These terms are governed by the laws of the Province of Ontario and the federal laws of Canada that apply there.
